لعدم الالتزام بتقديم الخدمة على الوجه السليم حكم بالإدانة ورد مبلغ أكثر من 58 ألف ريال عماني لصالح مستهلك في بركاء
أصدرت المحكمة الابتدائية بولاية بركاء حكمًا قضائيًا ضد إحدى المؤسسات التجارية، يقضي بإدانتها وتغريمها ماليًا لمخالفتها قانون حماية المستهلك الصادر بالمرسوم السلطاني رقم (66/2014م) ولائحته التنفيذية. تعود تفاصيل القضية إلى تلقي إدارة حماية المستهلك بمحافظة جنوب الباطنة بولاية بركاء شكوى من مستهلك أفاد بأنه تعاقد مع إحدى المؤسسات التجارية على تفصيل وتركيب نوافذ لمنزله، إلا أن المؤسسة لم تلتزم بتنفيذ العمل وفقًا للمواصفات المتفق عليها في العقد، ولم تنجز العمل في الوقت المحدد. وبعد تكرار محاولاته لحل المشكلة، قرر تقديم شكوى رسمية. لذا باشرت الإدارة باتخاذ الإجراءات القانونية، وأحالت القضية إلى الادعاء العام، الذي باشر التحقيقات وأحالها إلى المحكمة المختصة، والتي أصدرت حكمها بإدانة مالك المؤسسة لمخالفته قانون حماية المستهلك، لعدم الالتزام بتقديم الخدمة على الوجه السليم وبما يتفق مع طبيعتها. وقضت المحكمة بإدانة مالك المؤسسة وتغريمه ثلاثمائة ريال عماني، مع إلزامه برد مبلغ قدره ((58,794.600 ثمانية وخمسون ألفًا وسبعمائة وأربعة وتسعون ريالًا عمانيًا وستمائة بيسة للمدعي. وتدعو هيئة حماية المستهلك المؤسسات إلى الالتزام بالقوانين، وتجنب الممارسات المخالفة، مؤكدةً أنها لن تتوانى عن اتخاذ الإجراءات اللازمة للحفاظ على حقوق المستهلكين.
